Terms of Service

These terms are the agreement between you and Australian Standard Compute ("we", "us"), an Australian business. By creating an account, buying a plan or using an API key you agree to them. Questions: [email protected].
1. The service
We sell access to an AI language model (currently Qwen3.8-27B, an open model released under the Apache 2.0 licence) running on our own GPUs in Australia, through an OpenAI-compatible API. You buy a monthly plan with a fixed context size (16k, 32k, 64k or 96k tokens). A plan runs one request at a time unless you choose more at checkout, and its API key never runs more requests at once than the plan includes.
"Unlimited" means we do not count or charge for tokens or requests. It does not mean unlimited speed or unlimited requests at once: a plan is limited by its context size, by the number of requests it runs at once, and on smaller plans by the longest single answer shown on the plan.
Standard plans run on spare capacity. When our GPUs are full your request waits in a queue; a running request can be stopped when a Priority customer needs the capacity; and after five minutes of continuous work your place may pass to the next customer waiting, at the end of the answer being written. This is how the plan works, not a fault.
Priority plans have capacity held for them that is never sold to anyone else; they are never queued and never stopped for another customer. They are available around the clock, subject to power, internet and hardware outages and maintenance. We publish our measured uptime but do not guarantee a particular figure.
Speeds shown on the website are typical measurements, not promises. We may change the model, the hardware or the software to keep the service running or to improve it; if a change removes something your plan relies on, you may cancel and ask for a refund under our refund policy.
2. Your account and keys
You need an account with a working email address. Keep your password and API key secrets private: anything done with your key is treated as done by you. If a secret may have leaked, use "New secret" on your account page at once. You may use the service inside your own products and for your own customers, but you may not resell or share plain access to our API (for example by publishing a key or running a public proxy) without our written permission.
3. Acceptable use
You must not use the service to: break any law; create or seek child sexual abuse material; harass, threaten or defraud people; write malware or attack systems; generate spam; infringe other people's rights; or try to get around plan limits, rate limits, billing or the security of our systems. We may suspend a key or an account that breaks these rules, and close it for serious or repeated breaches. Where we reasonably can, we will tell you first.
4. Model output
AI output can be wrong, incomplete or offensive. Check it before you rely on it, and do not use it as the only basis for medical, legal, financial or safety decisions. You are responsible for how you use what the model writes. As between you and us, you own your prompts and the output.
5. Prices and payment
Prices are in Australian dollars, per month (a plan that runs several requests at once costs that many times the single price), and are charged in advance by card through our payment provider, Stripe. Priority plans can instead be paid three months at a time at the discount shown at checkout; such a plan renews every three months at the same price. Business customers who need a tax invoice showing our ABN can ask for one by email. Subscriptions renew automatically each month until cancelled. You can cancel at any time from your account page; the key keeps working until the end of the period you have paid for (one month, or three months for a plan paid three months at a time) and you are not charged again, and you can undo the cancellation until then. Your first plan can instead be cancelled with a full refund within 24 hours of paying, if it has used fewer than 100,000 tokens, as our refund policy explains. If a renewal payment fails, the key keeps working for three days while the payment is retried, then pauses until it succeeds. We will give at least 30 days' notice by email before a price change applies to an existing subscription. Refunds are covered by our refund policy.
Founding offer. The first 50 accounts created before launch on 15 October 2026 are founding members. A founding member's first monthly plan is 80% off its first month, then renews at the normal price. It must be bought within 30 days of launch, is one per founding member, does not apply to plans paid three months at a time, and cannot be combined with a promo code.
6. Privacy
We do not log or store your prompts or the model's answers. How we handle your account details is set out in our privacy policy.
7. Your consumer rights and our liability
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms limits those rights. To the extent the law allows, and except for those guarantees, the service is provided as is; we are not liable for indirect or consequential loss (such as lost profits or lost data); and our total liability to you is limited to the fees you paid us in the three months before the claim. Where the law allows us to limit our liability for a failure to meet a consumer guarantee, our liability is limited to supplying the service again or paying the cost of having it supplied again.
8. Ending the agreement
You can cancel your keys or ask us to delete your account at any time. We may end the service for everyone with at least 30 days' notice, refunding any part of a month already paid for that we cannot provide.
9. Changes and law
We may update these terms. We will email you about changes that matter before they apply, and continuing to use the service afterwards means you accept them. These terms are governed by the laws in force in Australia.
